On June 13, Polis signed Executive Order D 2020 101, which orders 'state agencies to help prevent evictions of tenants economically harmed by the coronavirus pandemic,' the State of Colorado says.

'Through this Executive Order, I encourage landlords to take steps to limit evictions for tenants who have made a good faith effort to make rental payments or who have made a good faith effort to establish a repayment agreement, and I direct the Department of Local Affairs (DOLA) to work with COVID-impacted landlords and tenants to create reasonable payment plans that allow tenants to remain in their residences while we return Coloradans to work safely,' Polis said in the order.

The order also suspends the requirement for landlords to give tenants ten days notice of non payment, after which they can initiate forcible entry. Thirty days is now required notice, so that tenants have more time to 'cure any default for nonpayment.'

Landlords and lenders aren't allowed to charge late fees or penalties if a tenant was financially unable to make a payment because of the COVID-19 pandemic between May 1 and June 13, 2020. The order, however, does not excuse individuals from making mortgage or rent payments.
