Woman Who Killed Pedestrian Won’t Be Charged, Just Ticketed

It's been determined that a woman who hit and killed a pedestrian will not be charged and just issued a ticket. According to the Coloradoan, 67-year-old Martha Bergland of Estes Park, hit and killed 63-year-old Spencer Longhibler on June 28, when he was crossing the street. Bergland hit Longhibler with her GMC Sierra when he was crossing the street in the crosswalk at the intersection of Elizabeth and Patton streets.

Longhibler was pinned under the truck, after being dragged for several yards and was pronounced dead at the hospital. After an investigation that lasted several weeks, it was determined that the accident was exactly that. Bergland was not distracted or impaired at the time of the accident and has been ticketed for "failure to yield the right of way to a pedestrian in a crosswalk." Authorities don't believe that Bergland was acting in a careless manner, but that she just didn't see Longhibler when he was in the crosswalk.
