The Jam Official Rules
No purchase or payment of any kind is necessary to enter or win.
These rules govern the inaugural The Jam Battle of the Bands promotion (the “Promotion”) being conducted by Townsquare Media LLC, KUAD-99.1 FM, KTRR-102.5 FM, KPPL-99.9 FM and KMAX-94.3 FM (the “Stations”) beginning Monday, June 17th 2013 at approximately 11:59am MST and ending on Sunday, July 12th, 2013 at 11:59pm MST.
To participate in the contest, you must be at least 13 years of age and not older than 19 years of age on the day of the final competition Sunday, July 14th 2013.
For purposes of these official rules, the publishing of your YouTube video link to Townsquare Media stations will be solely determined when Townsquare Media station servers record the registration information. Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of a registration form for the purpose of these official rules. The Townsquare Media station’s computer is the official time keeping device for this contest. Townsquare Media and its Stations are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technical problems.
All entrants must agree to The Jam’s Battle of the Bands online submission release in order to submit an entry.
All registration entries must be received by 11:59 PM MST July 7th 2013.
Limit one (1) entry per band.
Townsquare Media is not responsible for lost or stolen, damaged, mis-delivered, mangled, incomplete or late entries or for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technical glitches.
Each video submission must be the original performance of the entrant(s) and entrants must certify that any copyrighted work used in the submission, such as work of music performance in the video, has been properly licensed. Townsquare Media is not responsible for any copyright infringement on the part of the bands and their entries.
Townsquare Media, in its sole discretion, reserves the right to disqualify any video submission if such video submission contains illegal, indecent or otherwise offensive material, or if such act contains material whose content is deemed, at the sole discretion of Townsquare Media to be unsuitable for public performance or broadcast on the station (i.e. video submission must be radio clean).
Any entries whose submissions do not comply with these rules will be disqualified.
This competition is subject to all applicable federal, state and local laws and regulations and void where prohibited.
Winning band members will be required to provide valid photo identification, birth certificate, and proof of residence in Larimer or Weld counties, sign a return a winner release form and W-9 in order to claim the prize.
Entrants are required to provide truthful information and the stations will reject and delete any entry that is discovered to be false or fraudulent. Townsquare Media stations will disqualify any entry from individuals who do not meet the eligibility requirements. Townsquare Media will also delete any entry knowingly received from bands featuring persons under the age of 13 or over the age of 19.
Each winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of their prize.
Prizes do not represent any expectation of future employment at Townsquare Media, its stations or sponsors.
The winner will forfeit all prizes or prize certificates not claimed within ninety (90) days of winning. In the event that the prize or prize certificates is mailed to the winner, winner assumes all the risk of its loss. Townsquare Media is not responsible for the safe arrival of a prize or prize certificate.
There is no substitution, transfer or cash equivalent for prizes. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.
WINNER SELECTION AND NOTIFICATION
All decisions of Townsquare Media with respect to this contest are final.
Each entry meeting all eligibility and registration requirements of these official rules will be posted on Townsquare Media station websites where listeners can watch the entries and listen to the songs. Between July 8, 2013 at NOON at 11:59pm on July 12, 2013, any listener can go online to vote for their favorite band.
Top four voted bands will advance to the final Battle of the Bands competition.
Top four voting for prizes will be conducted by a panel of judges chosen by Townsquare Media stations. Judges will evaluate bands on a scale of 1-10 with the following criteria: Musical effort, performance fundamentals, technical ability, audience reaction and overall performance. The points from all the judges will be tabulated and winners will be announced based on total points for positions 1-3. All ties will be broken by judge’s votes on a separate judging scale.
Winners will be announced at the conclusion of the Battle of the Bands competition on or before 6pm on Sunday, July 14, 2013 at The Jam.
Odds of winning a prize depend on number of entries received by deadlines outline above.
Qualifiers do not need to listen to station to win.
The competing bands must execute and return any required affidavit of eligibility and/or liability/publicity release within five (5) days prior (Noon on July 9, 2013) to competition or will be deemed ineligible to compete.
Payments of all federal, state and local taxes are solely the responsibility of the winner (age 18 years or older or the parents of entrants 13-17 years of age.) The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number of the equivalent for the receipt of any prize valued at $100 or more or for any prizes awarded by Townsquare Media and its stations in a calendar year with an aggregate value of $100 or more. Failure to submit a complete W-9 or equivalent will result in a forfeiture of the prize. Such winnings of $100 or more will be reported to the IRS.
By participating in the contest, the winner(s) agrees to have their name, voice and likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
Prior to awarding any prize or prize certificate, Townsquare Media and its stations, in their sole discretion, will require promotion winners (age 18 or older OR the parents of entrants 13-17 years of age) to sign a liability release, agreeing to release and hold harmless Townsquare Media and its stations, the City of Fort Collins, its event sponsors – corporate licensees, licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the contest.
If for any reason this contest cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the contest, or if the contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Townsquare Media and its stations reserve the right to cancel, terminate or modify the contest.
Townsquare Media and its stations, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of the stations websites. Failure to comply with the rules of the contest may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If Townsquare Media and its stations make a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a contest, Townsquare Media and its stations reserve the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infections by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
The Townsquare Media reserves the right to make changes in the rules of the contest, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Townsquare Media and its stations, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of Townsquare Media.
Townsquare Media is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.
